Welcome to World Playground’s website (the “Website”). We provide online Travel Services through our Website, which services include but are not limited to hotel, cruise, and airfare booking and fulfillment services, as well as travel insurance. Other services include assisting and facilitating customers in gathering information regarding travel products and services, determining the availability of travel products and services, making legitimate reservations or otherwise transacting business with travel Suppliers (collectively, “Travel Services”). The Website is solely provided to assist customers regarding the Travel Services. The terms “we”, “us”, “our”, “World Playground” refer to World Playground LLC, a limited liability company organized and existing under the laws of the State of Wyoming, having an office and principal place of business located at PO BOX 940, Coeur D’Alene, ID 83816. The terms “you”, “user”, “customer”, or “traveler” refers to the individual visiting the Website and/or booking a reservation through us on this Website, or through our customer service agents, as well as all members of their group or traveling party.
Please read these Terms and Conditions carefully before using the Website or Travel Services, as they contain waivers of liability as well as a waiver of class action and venue selection and notice clauses.
1. CONTRACT.
a. The Website and Travel Services are offered to you conditioned upon your acceptance, without modification, of all the terms, conditions, and notices set forth below, as well as our Privacy Policy, which is incorporated herein by reference (collectively, the “Terms and Conditions” or “Agreement”). By completing and sending us your online order in relation to your Booking, and when we subsequently confirm the acceptance of your payment, you agree that the Terms and Conditions then in force shall apply. Where your Booking is completed via any other method other than through the Website (e.g., where one of our employees places the order on your behalf following email correspondence), this Agreement will be entered into on the basis of your explicit and binding offer to purchase a Booking following the provision of all relevant information in relation to your Booking by us to you. If you or the user(s) whom you are representing are not willing to be bound by all of these Terms and Conditions, including without limitation the preceding acknowledgement and agreement, then you must not continue to select the 'I agree' button associated with these Terms and Conditions and you must not access or use the Travel Services or any portion thereof or make any Booking (as defined herein); if you do not agree to these Terms and Conditions World Playground does not and will not grant you, and you do not have, any right or license to access or use the Website, Travel Services or any portion thereof. You may only use our Website to utilize the Travel Services and for no other purposes, commercial or otherwise.
b. By accessing or using the Website or our Travel Services, you, on behalf of yourself and the person(s) for whom you are accessing or using the Travel Services, acknowledge, agree and confirm that: (i) you are of sufficient legal age and capacity to use our Website and the Travel Services, and to create a binding legal contract, including responsibility for any liability you might incur as a result of the use of our Website and/or the Travel Services; (ii) you have read and understand all of these Terms and Conditions, and had the opportunity to review our Privacy Policy; (iii) you agree to be bound by all of these Terms and Conditions and you have full authority to bind your users and all persons in your group or traveling party to all of these Terms and Conditions; (iv) you acknowledge that these Terms and Conditions are the legal equivalent of a signed, written contract between World Playground and yourself, your users, and all members of your group or traveling party; (v) all information supplied by you, or those users using your name or account, in using our Website and/or Travel Services is true, complete, and correct; (vi) you are financially responsible for all uses of our Travel Services by you and those using your name and/or account; (vii) you acknowledge that some Suppliers have age requirements and restrictions for purchase and use of their accommodations and services, and you and those traveling with you shall be subject to such requirements and restrictions; and (viii) should you make a reservation and/or purchase for other people, you shall inform them of these Terms and Conditions, and the terms and conditions of all suppliers, policies, rules, and restrictions that apply. We reserve the right, in our sole discretion, to deny or suspend access to our Website or Travel Services to anyone, at any time and without prior notice, for any reason (including, without limitation, a violation of these Terms and Conditions).

You acknowledge and agree that you act as agent for all those named in any purchase made through the Travel Services and accept these Terms and Conditions on behalf of all persons named in any Booking (including those added at a later date). You represent and warrant that you are authorized to accept these Terms and Conditions for and on behalf of every person named in the Booking (including those added at a later date). Parents/legal guardians accept these Terms and Conditions on behalf of any minors.
2.DISCLAIMER OF AGENCY AND LIABILITY.
a. The information and offers contained on the Website (including text, graphics, links or other material) and regarding the Travel Services are provided on an “as is” and “where available” basis. World Playground makes no representation or warranty, express or implied, to you or another person or entity as to the accuracy, results, timeliness, completeness, merchantability, or fitness for any particular purpose, including but not limited to warranties arising by statute or otherwise in law or from a course of dealing or usage of trade, with respect to the site or any related materials, products, services, or information. Under no circumstances, including, but not limited to negligence, shall we, our providers, Suppliers or distributors, be liable for any damages to, or viruses that may infect your computer equipment or other property, or any loss of data you experience, on account of your access to, use of, or browsing on the Website, or your downloading of any materials, data, text, images, video, audio, or other information from the Website or associated with any email or links sent to you by World Playground. To the fullest extent provided by applicable law, in no event shall we, our providers, Suppliers or distributors, be liable for any injury, loss, claim, damage, or any special, punitive, exemplary, direct, indirect, incidental, or consequential damages of any kind (including, but not limited to, lost profits, lost business, or lost savings), whether based in contract, tort, strict liability, or otherwise, that arise out of or are in any way connected with the use, or the inability to use, the Website, Travel Services, or any other services or materials on the Website, or the travel reservations booked through World Playground (whether through this site or otherwise), even if advised of the possibility of such damages. In no event shall our aggregate liability, or that of our providers, Suppliers or distributors, exceed the total charges set forth in the itinerary giving rise to any such liability.
b. The Travel Services that we provide to you are in the capacity of an intermediary agent, serving as the merchant of record, with permission to sell products on behalf of various Suppliers. World Playground is only responsible for properly collecting and remitting amounts as merchant of record and for correctly passing your Booking and payment to the Supplier. We have an obligation to you to finalize the Booking on your behalf and arrange contracts between you and Suppliers. Any Travel Products that you purchase in connection with your Booking under this Agreement are provided to you by third-party Suppliers, not World Playground. The Suppliers are independent contractors and not agents or employees of the World Playground. World Playground is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such Suppliers or for any losses, personal injuries, death, property damage, or other damages or expenses resulting from your use of a Supplier’s travel products or services.
c. Though we endeavor to select reputable Suppliers to provide your Travel Products to you, the provision of Travel Products is outside of our control and scope of liability. Any arrangement made by us on your behalf is subject to the terms and conditions of the Supplier in charge of delivering the purchased Travel Products to you. The terms and conditions of your relevant Supplier can be provided to you on request and will be accessible at the time of Booking. If there are issues with the provision of your Travel Products, or the Supplier is unable to provide the contracted services, your legal rights are against the specific Supplier, not against World Playground, unless there has been an express fault on our part.
d. Except for situations where you are directly paying a Supplier (such as on-property at a hotel), for Bookings completed and paid through the Website, World Playground acts as a merchant of record intermediary, and charges to your Payment Method will be processed by or on behalf of World Playground. In those cases, your payment obligation is owed to World Playground, which then remits amounts to the applicable Suppliers as appropriate.
3.DEFINITIONS.
The following terms shall have the meanings assigned to them hereunder:
Accommodation Provider: means the provider of a hotel, home, accommodation, or other place of lodging.
Accommodation Room Descriptors: The following room and item descriptions on the World Playground website shall have the following meaning:
Single room: one single bed. Suitable for one person.
Twin room: two single beds in the same room. Suitable for two people.
Double room: one double bed. Suitable for two people.
Triple room: twin or double bed/s plus extra bed, or two double beds. Most hotels do not have one full size bed for each guest in their triple rooms.
Twin/double room for sole/single use: two single beds or one double bed in the same room, to be occupied by one person.
Quadruple room: twin or double bed/s plus extra beds, or two double beds. Most hotels do not have one full size bed for each guest in their quadruple rooms.
Twin/Double + child: twin or double room with an extra bed suitable for a child aged between two (2) and twelve (12) years.
Cot/cradle or crib: suitable for a child under the age of two (2) years.
Activity Provider: means the provider of any tours, activities, or experiences.
Additional Services: means a service related to your Booking provided by a Supplier, including (without limitation) upgrades, incidental charges, additional luggage, priority seating, meals, mini-bar, dry cleaning and laundry, passenger information change, rebooking, or cancellation. The fees associated with the provision of Additional Services are set by the Supplier and/or other third party and are not included in the Total Price, except where the requested Additional Services are added by you to your Booking with us during the Booking process, which may incur an additional handling fee charged by us that will be displayed to you at the time of your Booking. Where any Additional Services are sought by you following your completed purchase of a Booking, you acknowledge that these arrangements are your sole responsibility and that you will be required to directly contact the Supplier or any other third party as required to fulfill your request for the Additional Services.
Booking: means the process of reserving or purchasing a selected hotel, flight, cruise, or travel insurance option (including any multiple of these) and the resulting outcome of this process. A Booking is completed when we confirm that we have received and accepted your payment for the Total Price;
Carrier: means the airline providing the services of carriage by air. When placing a Booking, the identity of the Carrier (including the identity of the Carriers of any connecting flights) for your Booking will be made known to you. Please be aware that, due to circumstances beyond our control, the operating Carrier of your flight may be different from the one displayed at the time of your Booking. As such, it is important that you verify the identity of your operating Carrier prior to your departure.
Supplier: the independent, third-party owners and operators of Travel Products, including without limitation, transportation, accommodation, cruise lines, air carriers, and experience or activity providers, and/or tour operators, who are ultimately responsible for delivering the Travel Products in your Booking to you. For the avoidance of doubt, where a Booking involves multiple Suppliers, each Supplier is to be taken as a separate entity responsible only for the provision of their respective part of the services under the Booking.
Total Price: means the final price displayed immediately prior to the purchase of your Booking, including any Additional Services selected by you (e.g., additional luggage, upgrades, meals, etc.) during the Booking process.
Travel Document: means any physical or digital document that is intended to confirm a contract that we have arranged on your behalf with a Supplier. These documents may be, but are not limited to, hotel vouchers, airline itineraries/e-tickets, and activity tickets.
Travel Product: means the products, provided by Suppliers that we offer on behalf of the Suppliers on our Website, namely accommodation, flights, activities, and any Additional Services purchased during your Booking.
Travel Services: are as defined above. For clarification purposes, our Travel Services are strictly limited to: (i) Displaying information and pricing of Travel Products on the Website; (ii) The provision of Website functions that enable you to make a Booking and purchase Travel Products for the Total Price; (iii) The facilitation of the agreement between the relevant Supplier and you; and (iv) The delivery of your Travel Documents resulting from your Booking.
Website: means the website located at https://worldplayground.co/ and all associated subdomains at this location.
World Playground Account: means the registered account used to log in to the Website.
World Playground Credit Wallet: means the wallet associated with your Account on the Website used to store your WP Credits.
WP Credit: means loyalty credits issued by World Playground to eligible customers that are earnable when customers make Bookings through the Website.
4.SUPPLIERS & SUPPLIER TERMS.
a. We do not own, manage, control, provide, supply, or operate any of the Travel Products included in your Booking. We act as an agent for, and sell Travel Products on behalf of your Suppliers. Our obligation to you is to make travel Bookings on your behalf and to arrange agreements between you and Suppliers. All Bookings made on your behalf are subject to the terms and conditions related to the Travel Services of the relevant Supplier (collectively, “Supplier Terms”). Those Supplier Terms may include rules and restrictions about the Travel Products, exclusions, limitations of liability (including some which limit or exclude liability for death, personal injury, delay and loss or damage to baggage), restrictions on amendment or cancellation and other terms and conditions. It is important for you to obtain and read your applicable Supplier Terms. You agree to abide by such Supplier Terms, including without limitation payment of all amounts when due and compliance with the applicable terms, conditions, policies, rules, and restrictions. You understand that any violation of any such Supplier Terms, conditions, policies, rules, or restrictions, including without limitation timely payment, may result in: (i) you forfeiting any monies paid for such reservation or purchase; (ii) cancellation of your reservation or purchase; (iii) you being denied access to any hotels, or any other products or services; and (iv) us debiting your account for any costs we incur as a result of such violation. You acknowledge and agree that: (i) Suppliers may change their prices without notice prior to reservation or purchase by you; and (ii) you shall be responsible for all charges, fees, duties, taxes, and assessments arising out of your use of our Travel Services, including without limitation all reservations and purchases you make. You acknowledge that some Suppliers may require you to sign a liability waiver or other forms prior to using their services, and you understand that your unwillingness to do so may result in a cancellation of your reservation(s), being denied access to the Supplier’s services, and forfeiting any monies paid for such reservation(s), in accordance with applicable Supplier Terms.
b. Depending on your destination of travel, we may use the services of another travel Supplier inside or outside of the United States of America for the fulfillment of the Travel Services. Due to frequent changes, we cannot guarantee the accuracy of any information provided on/through our Website and/or the Travel Services, including without limitation any government or third-party websites we may reference, and we expressly disclaim any and all liability for inaccurate or incomplete information contained on such sites or provided by us.
c. In our role as a travel agent, we act as an intermediary agent and independent contractor between you and the Supplier(s); no joint venture, partnership, employment, agency, representative, fiduciary or similar relationship exists between you and us, or any Supplier related to the Travel Services, as a result of your use of the Travel Services. We merely assist you in finding Suppliers and making certain arrangements for travel. We consider numerous factors in identifying Suppliers and recommending specific itineraries. We want you to be aware that certain Suppliers pay us incentives for reaching sales targets or other goals. Suppliers may also provide compensation to us for various marketing and administrative services that we perform for them, such as granting them access to our marketing channels, participating in marketing programs, and supporting technology initiatives. The relationships we have with Suppliers may also influence the Suppliers we identify and the itineraries we recommend. While we may recommend certain destinations of travel and Suppliers, these are solely suggestions; any and all decisions as to appropriate destinations of travel and Suppliers are your sole and exclusive decision and we do not accept any responsibility or liability should you be dissatisfied, for any reason, due to the destinations and Suppliers we may suggest.
d. We reserve the right to change or remove any Travel Products advertised on the Website without notice, including, but not limited to, where the Supplier’s offer is changed or removed, or where a computer malfunction or human error has occurred. This includes prices quoted to you via email or any other method of correspondence. Our Website will subsequently be updated accordingly to reflect the accurate availability, information, and price of the Travel Product(s). In some cases, the price of a Travel Product may change between the time that you select the Travel Product and the time when you attempt to complete the purchase of your Booking. If a change of this nature occurs, we will take reasonable measures to ensure that you are aware of this change before you purchase the Booking. Please note that we are under no obligation to provide you with a reimbursement or refund of any kind if the price of a Travel Product becomes lower following the successful completion of your Booking.
5. YOUR WORLD PLAYGROUND ACCOUNT.
a. In order to use most aspects of the Travel Services, including to successfully purchase a Booking, you will be required to create a World Playground Account. As part of the registration process, you will need to provide certain information that enables us to create your World Playground Account. You acknowledge that it is your responsibility to ensure the confidentiality of your World Playground Account login credentials, including your password, and that you will be solely responsible for any actions conducted on your World Playground Account (including any Bookings). You agree to notify us immediately of any unauthorized use of your World Playground Account.
b. We may terminate or suspend access to your World Playground Account or your ability to use the Travel Services, in whole or in part, for any reason at our sole discretion and without notice or liability of any kind. Any such termination or suspension could prevent you from accessing your World Playground Account temporarily or permanently.
c. You may opt to terminate your World Playground Account at any time. By terminating your World Playground Account, you agree to discontinue your use of any and all parts of the Travel Services. To terminate your World Playground Account, please contact us at support@worldplayground.co or select the termination options in your account settings.
6. TRAVEL REQUIREMENTS; YOUR RESPONSIBILITIES
a. Our staff may be able to assist you with information pertaining to passports, visas, and other travel documents you may require for your trip. Please be aware that, while we can assist in providing this information to you, the information that we provide is general in nature and it is ultimately your responsibility to ensure that you have the relevant documents required for your trip. Any penalties, fines or additional expenses incurred as a result of the failure to obtain these documents will be incurred solely by you (subject to our liability).
b. Travel to certain destinations may involve greater risk than others. World Playground urges Travelers to remain informed daily as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to destinations can be found at http://www.state.govand http://www.cdc.gov. In addition, you should consult with government websites to ensure that you are following all requirements for admittance into that country, including COVID-19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, World Playground will not be liable for damages or losses that result from travel to such destinations.
c. It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), inoculations, and all other documents required by applicable government regulations. For up-to-date requirements US citizens should visit www.travel.state.gov. When traveling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids. Air travelers with identification (ID) that does not meet the REAL ID ACT requirements will have to use alternate ID forms (passport, military ID, or permanent resident card) to pass TSA security checkpoints—even for domestic travel. Please visit www.travel.state.gov or https://www.dhs.gov/real-id for the most updated requirements for travel documentation. Visas are required when they apply. Travelers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation. World Playground strongly recommends that you consider that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities.
d. Recommended inoculations and vaccinations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations and vaccinations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.
e. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler to miss flight(s), and subsequent scheduled travel bookings tours. World Playground bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.
f. You acknowledge that the information you provide when placing a Booking is accurate and up to date, and you agree that we shall bear no liability for any inaccurate information provided (except where the inaccuracy or error has resulted due to our, and not a Supplier’s, negligence). It is your responsibility to ensure that any information provided by you to us during the Booking process, including, without limitation, passenger details, travel dates, departure point and destination, is correct and that any documents you receive from us in relation to your Booking are in order.
g. Travelers are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s Web site, as this list is updated from time to time: https://www.transportation.gov/airconsumer/spray.
h. Baggage and personal effects are at all times the sole responsibility of the traveler. Due to continual changes in airline baggage policies, it is suggested that you inquire with your airline's website for up-to-date fees & information. World Playground is NOT responsible for additional fees incurred for baggage or seating. The Department of Transportation along with the Federal Aviation Administration outline which materials are hazardous to carry in your baggage. More detailed information on this is available at https://www.tsa.gov/travel/security-screening/whatcanibring/all.
i. It is your responsibility to ensure that you have a suitable level of health and fitness to undertake the trip of your choice. If you have doubts about your ability to undertake the trip, please contact us to discuss your circumstances prior to making a booking request. If you have a medical condition which may reasonably be expected to increase your risk of needing medical attention, or which may materially affect the usual conduct of the trip, then you must advise us prior to or at the time you make your booking request. If you are pregnant or expecting at or around the time of your planned travels, please inform us prior to booking. Some Suppliers will not permit travel past certain gestational periods for your safety and the safety of your child/ren. If you become pregnant after booking with us, please consult with a doctor and review the Supplier Terms and conditions as they relate to your booking to determine whether you will be permitted or prevented from traveling. If you are denied boarding embarkation, or access to a Supplier due to a pregnancy, or physical or mental disability, World Playground shall not be liable for any losses, expenses, or refunds resulting from such loss in access for you or anyone in your group.
j. If you have any special requirements, such as dietary requirements, seating arrangements, disabled access, or any other special requests, please make these requests during the Booking process (if available) or Contact Us immediately following the purchase of your Booking to allow as much time as possible for your requirements to be met. Please note that, while we will endeavor to accommodate your request(s), we cannot guarantee that your request(s) will be honored by the Supplier.
k. You acknowledge that there may be flight delays (due to circumstances beyond the control of the company) that may lead to interference with a tour for which you have booked. You agree that we will not be responsible for any flight delays or loss of flight connections whether such loss is caused by you, us, any of its suppliers, an airline or other. In the case of any loss of flight connections, whilst we will use best endeavors to continue with the booked tour, we will not be liable to compensate you for any lost part of your itinerary and we will not be liable to pay for any additional costs you may incur. We strongly recommend that your policy of travel insurance has coverage for flight cancellations and delays. You acknowledge that it is your responsibility to check-in on time for your flight at any airport. We will not be responsible for any flights that are not taken due to your late arrival at any airport. It is also your responsibility to contact the relevant airlines to confirm flight details if relevant.
7. YOUR TRAVEL DOCUMENTS.
a. Your Travel Document(s) will be delivered to you electronically to the email address provided by you at the time of your Booking. You acknowledge that it is your responsibility to ensure that the email address you provide is entered correctly and that you will immediately notify us where an error has been made on your part. We shall not be liable for any delay or failure to deliver your Travel Document(s) where the delay or failure was made on your part. The Supplier or other relevant authorities may require you to present any of the following documents in either electronic or printed format: your itinerary/e-ticket(s), boarding pass(es), visa(s), passport, or any other relevant document.
b. Certain conditions or restrictions may be imposed on Travel Documents, such as being non-refundable or subject to amendment or cancellation fees. Please ensure that you carefully read each Travel Document upon its receipt to ensure that it is in order.
c. Travel Documents are non-transferable. Where a Booking for a flight with a Carrier is purchased, the Travel Document must be issued in the name of the passport/photo identity holder. Please ensure that the details on your Booking are correct and confirm that the name, date of birth, and document number of all travelers is correct. If there is a mistake on your Travel Document, such as an incorrect name or date of birth, please support@worldplayground.coimmediately.
d. Any health requirements or precautions associated with your trip are your responsibility. Please ensure that you have any relevant vaccination documentation if you are traveling to a country requiring proof of vaccination. It is also generally good practice to visit your general practitioner or vaccination clinic before your trip to see if any vaccinations are required for your travel.
8. TRAVEL INSURANCE AND TRAVEL ADVICE.
a. Unforeseen circumstances may arise when traveling. For this reason, it is strongly recommended that you consider whether you require travel insurance, especially for international travel. It is recommended that your travel insurance cover medical expenses, personal injury, death, loss of luggage, loss of money, cancellation, and personal liability insurance. Please note that we do not sell travel insurance, though we provide you with general information regarding travel insurance, and connect you with Suppliers and third parties who sell travel insurance. While World Playground may recommend travel insurance options for you to choose from, we are not liable for any issues that result from said travel insurance options. World Playground is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel coverage plans and as such World Playground cannot evaluate the adequacy of the prospective insured's existing insurance coverage. World Playground cannot guarantee that any insurance provider will approve coverage for a claim made under the insurer’s policy and makes no representations about the extent of coverage for any policy it may offer or quote. Please note that any and all cancellation fees will not be accepted as part of your claim. If you have any questions about your travel protection, call your insurer or insurance agent or broker.
b. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. World Playground cannot be held responsible for denied entry if a traveler is unable to provide such details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate insurance coverage, World Playground will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.
c. General travel advice and country-specific travel advice is provided by most countries. While we may be able to provide general information to you in relation to country-specific travel advice, we make no representations as to the accuracy of this information and shall bear no liability for any resulting damages. By purchasing a Booking, we assume that your country of departure permits you to visit the destination of your Booking or any transits in between. We shall bear no liability for any cancellation fees or other fees that you may incur as a result of your inability to use your Booking.
d. FEDERAL LAW FORBIDS THE CARRIAGE OF HAZARDOUS MATERIALS ABOARD AIRCRAFT IN YOUR LUGGAGE OR ON YOUR PERSON. A VIOLATION CAN RESULT IN FIVE YEARS’ IMPRISONMENT AND PENALTIES OF $250,000 OR MORE (49 U.S.C. 5124). HAZARDOUS MATERIALS INCLUDE EXPLOSIVES, COMPRESSED GASES, FLAMMABLE LIQUIDS AND SOLIDS, OXIDIZERS, POISONS, CORROSIVES AND RADIOACTIVE MATERIALS. EXAMPLES: PAINTS, LIGHTER FLUID, FIREWORKS, TEAR GASES, OXYGEN BOTTLES, AND RADIO-PHARMACEUTICALS. THERE ARE SPECIAL EXCEPTIONS FOR SMALL QUANTITIES (UP TO 70 OUNCES TOTAL) OF MEDICINAL AND TOILET ARTICLES CARRIED IN YOUR LUGGAGE AND CERTAIN SMOKING MATERIALS CARRIED ON YOUR PERSON.
9. PAYMENTS; PURCHASE OF TRAVEL PRODUCTS.
a. Your price will only be guaranteed once the Total Price for your Booking has been paid in full. Please note that taxes are subject to change and the tax is finalized when your Travel Document is issued. You also acknowledge that World Playground is not subject to VAT, and therefore no VAT invoice will be issued to you following the successful completion of your Booking. At the time of Booking, you will be charged the total cost of the Supplier’s Travel Products that you selected, including taxes and fees (but excluding any specific Supplier fees charged directly to you by the Supplier, such as any mandatory hotel-imposed charges that may be applicable upon check out from the hotel or resort fees, and any airfare fees including, but not limited to, baggage fees, seat assignment fees, early boarding fees, etc.). Any incidental charges that you make during your stay (which must be settled between you and the Supplier) will be charged to you by the property upon check-out, including but not limited to parking, phone calls, internet access and room service. Car rentals may require a credit or debit card at the time of pick-up for any vehicle as a form of security and/or hold.
b. World Playground receives payment from you and then remits relevant amounts to Suppliers. Thus, you understand that, since World Playground is the merchant of record, the descriptor that will appear on your credit or debit card statement will reference World Playground. We accept payment via select credit and debit cards (collectively “Payment Method”). Please see our website for an up-to-date list of current options.
c. By agreeing to these Terms and Conditions, you authorize us to charge your designated credit or debit card for all fees incurred by you in relation to the Travel Services provided by us. Please note that a service fee may be incurred on credit and debit card payments. The applicable service fee will be displayed to you prior to the completion of your Booking. By purchasing a Booking using a credit or debit card, you acknowledge that we will not be liable for any additional costs you incur associated with exchange rates, bank fees, credit card fees or debit card fees. For clarity, World Playground will not refund any such charge to your credit card, debit card, or World Playground Credit Wallet.
d. We reserve the right to delegate the management of all or part of our electronic payment collection to our subsidiaries or third-party payment providers. Any fees incurred by you as a result of purchasing a Travel Product from us are non-refundable, subject to your rights under applicable law.
e. You agree that our payment providers can securely store your payment details, which can subsequently be used by us for later payment in connection with your Booking. Upon submitting your Booking form, you authorize us to facilitate reservations on your behalf, including making payment arrangements with Suppliers and any third parties related to the provision of your Booking.
f. For payments made online via the Website, you will not pay the Supplier for the Travel Product mentioned on the Travel Document. Only Bookings made using direct payment with a Supplier (e.g., in person at a hotel) will allow you to pay for your reservation once you arrive at the establishment. These two distinct payment options are clearly displayed during the Booking process.
g. For Bookings made via a World Playground employee, a deposit (or deposits) may be required. The amount of the deposit and number of deposits (for multiple Bookings) will be communicated to you via a World Playground employee. Should an amendment or cancellation be made by you, your deposit(s) may be forfeited (subject to your rights under applicable law). Since final payments for Bookings with Suppliers are variable, we will advise you when final payment for your Booking is due.
h. Exceptionally, World Playground may, at its sole discretion, offer you the option to pay a low deposit for certain group Bookings with Accommodation Providers (“Early Booking”). This will be indicated next to the specific Travel Product in your search results. An Early Booking requires a partial payment at the time of reservation and confirmation and a secondary payment consisting of the total balance due at a future point in time, as communicated in your confirmation email or other correspondence from us to you. The later payment will be automatically collected on the due date. You must make sure that the Payment Method is valid and has enough funds at the time of the balance payment. In case the Payment Method cannot be charged for whatever reason, you can pay the remaining balance using a valid Payment Method. If the payment is not authorized in due time, the Booking will be cancelled, and any deposit shall be deemed non-refundable and forfeited by you.
i. If your chosen Travel Product is not available and we provide you with an alternative option, your Payment Method will only be charged if you accept the new Travel Product and the new rate offered. If you do not accept the given alternative, no charge will be made to your Payment Method by World Playground.
j. Any personal information that you submit to us in relation to the purchase of your Booking will be protected by our third party payment processor, Very Good Security (https://www.verygoodsecurity.com/about-us). This technology encrypts all information and all personal information passed from you through our Website.
k. If you wish to derive the benefits associated with a particular frequent flyer program when purchasing a Booking for a flight with a Carrier, you acknowledge that it is your responsibility to provide us with your rewards, loyalty, or frequent flyer number, either during the Booking process in the relevant section of the Booking form on the Website or via correspondence with us at any time before your departure. Please note that we will not be liable for any foregone frequent flyer benefits under any circumstances and we cannot guarantee that the Carrier will honor your rewards loyalty, or frequent flyer number, and shall have no liability or responsibility to you if the Carrier does not provide you with rewards, loyalty points or frequent flyer miles in connection with your Booking.
10. CHANGES, CANCELLATIONS AND REFUNDS
a. Any cancellation or change, if permitted, is subject to the policies of the Suppliers that you selected (e.g., any cancellation of a flight Booking shall be subject to the Supplier/Carrier’s cancellation terms/policy). The applicable cancellation policy of the Travel Product (except in the instance of flights, notwithstanding the definition of a Travel Product defined herein) is displayed prior to your completion of the online Booking form. Please ensure that you read the cancellation policy applicable to your selected Travel Product carefully as the cancellation policy varies between Suppliers and the respective Travel Products that are offered. If permitted, and you choose to change your Booking, you may incur a change fee, plus any difference in the fare attributable to the change. If your Booking is with multiple Suppliers, and if cancellation is permitted by one Supplier and not the other, you will not be refunded for the portion of your trip for which cancellations are not permitted and you will be required to cancel your entire trip. If cancellation is permitted, you may incur a cancellation fee. The amount of the cancellation fee will depend on the Supplier Terms that you selected. Upon receipt, you are responsible for promptly reviewing your Booking confirmation/itinerary for accuracy and immediately notifying us of any errors.
b. Voluntary changes for flight bookings can generally only be requested up to 72 hours before departure, and no later than 24 hours before departure. For U.S. domestic flights, we will endeavor to implement your change to your flight booking if requested at least 24 hours before your flight, but cannot guarantee the same. If you voluntarily cancel or make changes to your Booking, the Supplier may charge a cancellation or change fee. Voluntary cancellations or changes to Bookings cannot be reversed once requested by you. Where a change or cancellation to a Booking is made, processing fees may be applied by us in addition to the charges imposed by the Supplier. If your flight booking contains multiple passengers, any changes you make will apply to the itinerary of all passengers relevant to that Booking; if you wish to change the Booking for some (not all) passengers, you acknowledge that it is your sole responsibility to make these arrangements directly with the Carrier. Please be aware that some Bookings may be non-refundable, and in this instance, we cannot provide you with a refund. Where you request a voluntary cancellation on a Booking that may be refundable, please be aware that we may not be able to accurately calculate the refund amount that you will receive at the time of your cancellation request. If you arrive late on your scheduled Booking date (as stated on your Travel Document), decide to leave before the conclusion of the Travel Product (as stated on your Travel Document), or fail to arrive (no-show), World Playground will not issue any refunds. Please note that, in some cases, you may be charged for the cancellation fee in accordance with the Supplier’s cancellation policy if the amendment is made after a certain date or falls under an exception. When you cancel a flight Booking, the Booking may be cancelled for all passengers booked under the same Booking, depending on the policy of the Carrier.
c. If your Booking is cancelled or changed by the Supplier or a related third party, we will endeavor to notify you of the corresponding cancellation or change as soon as possible. Please note that we are not liable for the consequences of any cancellations or changes made by these Suppliers or any other third parties.
d. If you wish to modify the dates of your Booking with an Accommodation Provider, please log in to your World Playground Account and use the "Change my dates" form subject to the Booking term allowing for such changes. For other types of modifications to Bookings with Accommodation Providers, or to modify Bookings with Carriers or Activity Providers, please support@worldplayground.co. Reservations not amended through World Playground will become subject to a 100% charge to be applied. Any requested modifications are subject to a Booking (and Supplier) that allows modifications.
e. In the event of a confirmed Booking with an Accommodation Provider becoming unavailable before the check-in date, World Playground will offer a full refund in the form of a WP Credit. Where we have prior notice, we will contact you by email. However, upon check-in, if the original Travel Product specified in your Travel Document is closed, overbooked, or has maintenance problems and cannot provide the room(s) booked, you accept that the Accommodation Provider is responsible for finding you alternative accommodation of a similar standard and/or for providing you with a refund. You acknowledge that World Playground will not be liable to you and will not provide you with a refund or alternative accommodation.
f. If you are entitled to a refund, either in part or in full, the refund amount that you are entitled to will exclusively be in the form of WP Credits (except where applicable law requires a refund to the original payment method). Where a refund is properly due to you and we have received your cancellation or amendment email, we will refund your World Playground Credit Wallet within five (5) days after we have received the applicable refund sum from the respective Supplier.
11. ADDITIONAL TERMS CONCERNING WP CREDITS.
a. All refunds described in these Terms and Conditions shall be issued in the form of WP Credits, unless expressly stated otherwise. WP Credits can only be used to reduce the purchase price for eligible travel product components (e.g., accommodations, cruises, flights, and travel insurance) and cannot be applied to partial payments of the Total Price; each redemption must fully cover the price of the specific component.
b. Each WP Credit is redeemable in an equivalent amount of one U.S. dollar ($1.00) that may be applied as a discount against the purchase price of eligible travel products through World Playground. WP Credits have no cash value, cannot be exchanged, withdrawn, sold, or redeemed for actual currency or payment of any kind, including without limitation U.S. Dollars. All users acknowledge that WP Credits are promotional tools with no monetary value and accept that no cash or equivalent will be provided in lieu of WP Credits.
c. WP Credits do not expire and have no time restrictions for redemption.
d. WP Credits are non-transferable and may only be used by the account holder to whom they were issued.
e. World Playground does not guarantee the availability of any travel product in exchange for WP Credits, and the value of WP Credits may not be combined with other discounts or offers, except as expressly permitted.
f. World Playground shall not be liable for any loss or damage arising from the inability to use WP Credits due to system errors, suspension, or other circumstances beyond World Playground’s control.
12. CREDIT CARD BOOKINGS.
a. Payments can be made via debit card or major credit cards including Visa, Mastercard and American Express. You must provide us a clickwrap (checkbox) or signed authorization for every transaction for your trip. You understand, acknowledge, and agree to authorize us, as merchant of record, to charge your credit and/or debit card for any Bookings. Your authorization is a legally binding agreement for World Playground to charge your card and an acknowledgement and agreement to these Terms and Conditions including the cancellation terms. As such, you agree not to make any improper chargebacks.
b. In addition, you agree to maintain a valid card on file and promptly update World Playground if your credit card details change. You confirm that you are an authorized owner or user of the card you provide. Additionally, you agree not to dispute any charges with your credit card company, as long as the transaction aligns with the terms of this contract. Further, you also consent to us sharing your payment information and necessary instructions with third-party payment Suppliers (e.g., credit card processors, merchant services, and related services) in order to complete the payment transactions.
c. If, for whatever reason the credit/debit card you provide for any payment is subsequently found to be fraudulent or lacking sufficient limits or funds to make the full payment, we reserve the right to perform any (or a combination) of the following: (i) decline your payment and require another form of payment to secure your Booking (and your Booking will not be confirmed or reserved until an additional, valid and legitimate form of payment is provided); (ii) cancel any reservation/s you made, and if fraudulent, refund all monies used for the reservation to the user or victim of the fraud; (iii) immediately require full payment from another credit card at the going rate for your accommodation(s) at the time of your full payment; (iv) terminate and restrict your ability to utilize our services at any time in the future; and/or (v) pursue any remedy necessary, including, but not limited to pursuing legal action.
d. In certain cases, you can dispute charges with credit card and other payment facilitation companies ("chargebacks"). Before initiating a chargeback, you must send an email to us at support@worldplayground.co concerning any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. World Playground retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees, related to improper chargebacks and to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut the chargeback claims below, including without limitation:
Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card (this does not include credit card fraud).
Chargebacks arising from inconsistency or inaccuracy with regard to the Supplier’s product description.
Chargebacks resulting from force majeure or other circumstances that are beyond the control of World Playground or the Supplier.
Chargebacks resulting because you do not agree with the cancellation policy.
Chargebacks resulting because you were not provided with an itemized breakdown of costs in connection with your trip.
Chargebacks resulting from an experience where you were not satisfied with the Travel Products provided by travel Supplier.
12. PERMITTED & PROHIBITED USES
a. In using the Website and our Travel Services, you represent and warrant that you:
i. will use the Website strictly for personal and non-commercial purposes only and you acknowledge that use of the Website for any other purpose is prohibited;
ii. will not gather, extract, reproduce and/or display on any other website or other online service, any material on or from the Website, specifically including information relating to Travel Product pricing and availability, whether using robots, spiders, or other "screen scraping" software or system used to extract data;
iii. will not use the Website to resell World Playground’s Bookings or details of Travel Product pricing and availability or other information to any other persons or organizations, other than for your personal and non-commercial use;
iv. will not use the Website for any purpose that is either unlawful or not allowed under this Agreement.
v. will not commit any act that would constitute a breach of either the privacy rights (including uploading private or personal information without an individual’s consent) of individuals, or any other of the legal rights of individuals;
vi. will not use the Website while impersonating another person;
vii. will not use the Website to defame or libel us, our employees or other individuals;
viii. will not transmit any viruses, trojan horses, worms, malicious code, trackers, or other similar items that may cause damage to our property or the property of other individuals;
ix. will not post or transmit to this Website any non-authorized material including, but not limited to, material that is, in our opinion, likely to cause annoyance, or which is defamatory, racist, obscene, threatening, pornographic or otherwise, or which is detrimental to or in violation of our systems or a third party’s systems or network security;
x. will not tamper with, hinder the operation of, or make unauthorized modifications to the Website (including deleting data from the Website without our permission);
xi. will not breach any third party’s rights (including intellectual property rights and obligations of confidentiality owed to third parties) or infringe any laws in any jurisdiction in using the Website; and
xii. will not attempt to gain unauthorized access to the Website, user accounts, or computer networks or systems connected to the Website through hacking, password mining, or any other means.
b. To make a Booking on the Website, you must be at least 18 years of age (or the legal minimum age in countries where the legal minimum age is greater than 18). By entering into this agreement, you confirm that you possess the legal authority and necessary minimum age to use the Website in accordance with this Agreement. World Playground will not compensate you or anyone else for any expenses incurred as a result of minors using the Website, including any Bookings placed by minors.
c. Unless otherwise indicated, we own, or license from third parties, all rights, title, and interest (including, without limitation, copyright, designs, patents, trademarks and other intellectual property rights) contained on the Website and in all of the material (including, without limitation, all text, graphics, logos, audio and software) made available on the Website (“Content”). Your use of the Website and use of and access to any Content does not grant or transfer any rights, title, or interest to you in relation to the Website or the Content. However, we do grant you a license to access the Website and view the Content on the terms and conditions set out in this Agreement and, where applicable, as expressly authorized by us and/or our third-party licensors. Any reproduction or redistribution of the Website or Content is prohibited and may result in penalties. In addition, you must not copy the Content to any other server, location or support for publication, reproduction, or distribution is expressly prohibited. All other use, copying, or reproduction of the Website, the Content, or any part of the Website or Content is prohibited, except to the extent permitted by law.
d. We will determine, in our sole and absolute discretion, whether there has been a breach of this Agreement through your use of the Website. If a breach of this Agreement has occurred, we may take such action as we deem appropriate, including denying you access to the Website, bringing legal proceedings against you, or disclosing such information to law enforcement authorities as we deem appropriate.
e. Our Website may contain links to other websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. We are not liable to you if interference with or damage to your computer systems occurs in connection with the use of the Website or any linked website. You must take your own precautions to ensure that whatever you select for your use from our Website is free of viruses or any other malware that may interfere with or damage the operations of your computer systems.
f. If we allow you to post any information to the Website, we have the right to take down this information at our sole and absolute discretion and without notice.
g. By using the Website, or by entering into correspondence with us through email, telephone, or other communication tools, you agree that we may communicate with you through methods including, but not limited to, email, telephone, messaging applications, and in-app notifications. If you wish to unsubscribe from marketing emails, please click ‘Unsubscribe’ at the footer of any of our marketing emails or contact us at support@worldplayground.co. Please note that, if you unsubscribe from our marketing emails, you will still receive non-marketing emails from us (including emails relating to any Bookings that you place).
h. If you do not agree with any of the terms and conditions of this Agreement, you must not use the Website.
13. LIMITED WARRANTY; NO OTHER WARRANTIES.
a. We represent and warrant to you that our Travel Services: (a) will be provided with due care and skill; (b) will be reasonably fit for the specified purpose; (c) can be reasonably expected to achieve the desired result; and (d) will be provided within a reasonable time.
b. EXCEPT AS DESCRIBED IN THE PRECEDING ITEM ABOVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE MAKE NO REPRESENTATIONS, WARRANTIES OR GUARANTEES ABOUT THE TRAVEL PRODUCTS AND SERVICES THAT WE SELL AND THEIR AVAILABILITY, SAFETY, OR RELIABILITY.
14. LIMITATION OF LIABILITY; INDEMNIFICATION.
a. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT DOES WORLD PLAYGROUND NOR ANY OF ITS DIRECTORS, EMPLOYEES, AGENTS, OR RELATED BODIES CORPORATE ACCEPT LIABILITY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING, WITHOUT LIMITATION, DELAY, INCONVENIENCE OR ADDITIONAL EXPENSE WHICH MAY BE SUFFERED DUE TO (WITHOUT LIMITATION) YOUR USE OF, OR THE INABILITY TO USE, OUR SERVICES, THIRD PARTY PROVIDERS, FORCE MAJEURE, OR EVENTS THAT WE CANNOT CONTROL OR WHICH COULD NOT HAVE BEEN PREVENTED BY REASONABLE DILIGENCE ON OUR PART.
b. IF IT IS DETERMINED THAT WORLD PLAYGROUND IS LIABLE FOR ANY LOSS OR DAMAGE THAT ARISES OUT OF, OR IS CONNECTED TO, YOUR USE OF OUR SERVICES, OUR MAXIMUM LIABILITY UNDER THIS AGREEMENT WILL BE LIMITED TO THE REISSUE OF YOUR BOOKING (OR CORRECTING THE DEFECTIVE PART OF YOUR BOOKING), OR THE PROVISION OF CREDIT OR REFUND FOR THE TOTAL PRICE OF YOUR BOOKING AT THE PRO RATA CONTRACT RATE.
c. IN THE EVENT THAT THIS PROVISION IS UNENFORCEABLE IN YOUR JURISDICTION, THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS WILL APPLY TO THE MAXIMUM EXTENT POSSIBLE, AS PERMITTED BY APPLICABLE LAW.
d. To the fullest extent permitted by law, you agree to fully indemnify, defend, release and hold harmless World Playground and its Representatives (including our affiliated, subsidiary and/or parent companies) for any and all (without limitation) damages, costs, expenses, liabilities, fines and or penalties, including attorney fees, which arise as a result of your breach of this Agreement or your use of the Travel Services, or any other terms supplemental or related to World Playground, your violation of any applicable law or the rights of any third parties, any force majeure or inherent risk of travel, and/or any other act or omission by you which is in relation to the subject matter of this Agreement, as well as any claims brought by third parties in connection with the foregoing.
e. In the event that a user breaches any material term of the Terms and Conditions of Booking, the user agrees to pay World Playground liquidated damages in an amount equal to $50,000.00 per breach, or, if actual damages are reasonably quantifiable, then such actual damages as determined by World Playground, whichever is greater. The parties agree that actual damages resulting from such breaches would be difficult to ascertain and that the foregoing amount represents a reasonable estimate of the loss likely to be incurred by World Playground and is not intended as a penalty. Payment of liquidated damages shall be due within ten (10) days of written notice from World Playground. This provision does not limit World Playground’s right to pursue other remedies available at law or equity.
15. ASSUMPTION OF RISKS OF TRAVEL.
a. You and all members of your traveling party are aware that the travel you are undertaking involves inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor and conveyance vehicle collisions, animals, roadway hazards, slips, and falls, uneven terrain, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, World Playground and its Representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; foodborne illnesses, dietary restrictions or allergic reactions, fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.
b. You understand the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death. In order to partake of the enjoyment and excitement of this trip, traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Traveler hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release World Playground and its employees, shareholders, agents, and representatives (“Representatives”) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of World Playground and/or its Representatives and traveler hereby covenant not to sue World Playground and/or its Representatives for any such claims or join any lawsuit or action that is suing World Playground. These Terms and Conditions also bind your heirs, legal representatives and assigns. The terms of this hold harmless and release of liability paragraph, shall survive any termination or cancellation of these Terms and Conditions, whether by operation of law or otherwise.
16. MISCELLANEOUS.
a. We may make improvements to, and/or change, the Website at any time. World Playground, its Suppliers, and any of its related third parties make no representation about the suitability of the information, software, products and services contained on the Website for any purpose, and the inclusion or offering for sale of any products or services on this Website does not constitute any endorsement or recommendation of such products or services by World Playground. All such information, software, products and services are provided "as is" and without warranty of any kind.
b. You agree that, by using our Services, no joint venture, agency, partnership, or employment relationship exists between you and us.
c. The tax charge on any Travel Product purchases via World Playground is a recovery of all applicable transaction taxes that World Playground pays its suppliers in connection with your travel arrangements. Taxability and the appropriate tax rate can vary greatly by location. World Playground's actual tax cost paid to the supplier may vary from the tax recovery charge, depending upon the rates and taxability in effect at the time. You acknowledge that World Playground is under no obligation to account to you or refund you in this regard.
d. The currency rates displayed on the Website are not verified or guaranteed by World Playground as being accurate and should be used as guidelines only. Rates are not guaranteed to be updated every day and actual rates may vary. Regardless of if you are located outside of the United States, we will process your credit card payment in U.S. Dollars. However, in some circumstances we may process your credit card payment in USD. You acknowledge and agree that some banks and credit card companies charge fees for international or cross border transactions. The same shall apply for any payments you choose to make while on-site at any international accommodation (including, but not limited to, resort fees, VAT taxes, etc.). Often booking international travel may be considered an international transaction by your bank or credit card company. Some banks and credit card companies also charge a currency conversion fee. For example, if your Booking is in a currency that differs from your credit card currency, your credit card company may impose a currency conversion fee. This fee is determined solely by the currency exchange rate and your credit card company or bank typically on the day the transaction is processed. If you have questions concerning any of these fees, please contact your bank or credit card company prior to booking on the Website.
e. The information, software, products, and services published, displayed or used on the Website may include inaccuracies or errors, including pricing or typographical errors. World Playground and its affiliates do not guarantee the accuracy of any part of the Website and disclaim all liability for any errors or other inaccuracies relating to the information, pricing, descriptions of Travel Products; photographs of Travel Products; property of Accommodation Providers, or lists of amenities or facilities and their respective availability. In addition, World Playground expressly reserves the right to correct any pricing errors on our Website on pending and/or confirmed reservations made under an incorrect price. In such an event, if available, we will offer you the opportunity to keep your pending Booking at the correct price or, if you decline, we will cancel your Booking, which may incur penalties pursuant to the applicable Supplier’s terms and conditions. If the pricing error is due to the fault of the Supplier, World Playground shall not have any responsibility or liability in connection therewith, and you must contact (and make all claims against) your particular Supplier.
f. Any ratings of Travel Products displayed on the Website are intended only as general guidelines. World Playground does not, therefore, guarantee the accuracy of the ratings, which may change from time to time. Any reliance you place on such ratings is at your own entire risk.
g. We reserve the right not to accept customers or Bookings (or, in exceptional cases, to cancel confirmed ones) in our sole and absolute discretion and for any reason or no reason without the need to justify such refusal. Typical reasons for rejecting a customer or Booking include, but are not limited to: Supplier request, breach of this Agreement, trade or economic sanctions, embargoes, legal restrictions, (suspicions of) fraud or theft, suspected criminal activity, suspicious Bookings, submission by customer of misleading or erroneous information, credit card problems, inappropriate behavior, threats, insults, refusal to supply information, practical obstacles, communication problems, obvious errors (see below), history, or blacklisting by governments or international organizations. Where a Booking is rejected or cancelled by World Playground and a payment has already been made, you will receive a refund, in the form of WP Credits, of the Total Price. We also reserve the right to bar (“blacklist”) users from the Website, on a permanent or temporary basis, in our sole and absolute discretion. Any such blacklisted user must not attempt to use the Website under any other name or through any other user. You must also not create more than one World Playground Account. In rare cases, we may also have to cancel or reject a Booking due to “obvious errors”, independent of the origin of such errors. For clarity, an obvious error is a mistake on the Website (e.g., in terms of price) which a reasonable person would not consider to be normal. The amount charged will be reimbursed without charge in such case. Whether to cancel or reject a Booking for this reason is in World Playground’s sole discretion.
h. This Agreement is subject to existing laws and legal processes that World Playground is subject to in delivering the Travel Services. Nothing contained in this Agreement limits our right to comply with law enforcement, governmental or legal requests, or requirements relating to your use of the Travel Services.
i. This Agreement, including any other relevant terms and conditions or policies referenced herein, constitute the entire agreement between you and World Playground with respect to the Travel Services. This Agreement supersedes all prior or contemporaneous communications (whether electronic, oral, or written) between you and World Playground with respect to the Travel Services.
j. If any provision of this Agreement is deemed invalid or unenforceable, the provision will be enforceable to the maximum extent permissible and the remaining provisions will remain in full force and effect. Any invalid or ineffective provision shall be replaced with a new, valid and effective one which corresponds to the intent and purpose of the provision that is being replaced.
k. This Agreement may be amended at any stage without notice in our sole and absolute discretion and will be effective immediately upon its publication on the Website. By continuing to use the Travel Services, you agree to the changes set out in this Agreement. If you do not agree to any modification to this Agreement, you must cease using our Travel Services immediately. We encourage you to review this Agreement often to stay up to date with the current terms and conditions that apply to your use of the Travel Services.
l. Failure by us to exercise or enforce any right or provision of these legally binding Terms and Conditions shall not constitute a waiver of such right or provision. Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party. The provisions of these Terms and Conditions, which by their nature extend beyond termination or expiration of these Terms and Conditions (whether by operation of law or otherwise) shall survive the expiration or termination of these Terms and Conditions to the full extent necessary for their enforcement and for the protection of the party in whose favor they operate. These Terms and Conditions shall be written in, and all other communication under or in connection with these Terms and Conditions shall be in, the English language. Any translation into any other language shall not be an official version thereof, and in the event of any conflict in the interpretation between the English version and such translation the English version shall control.
m. The information and personal data that you provide when purchasing a Booking is processed in accordance with our Privacy Policy, which is available on our website or upon request, and which forms an inseparable part of this Agreement and is incorporated herein by reference. You acknowledge and agree that by providing us with any personal information through our Website or the Travel Services, you consent to the transmission of such personal information over international borders as necessary for processing in accordance with our standard business practices and applicable law and regulations. We may also share your personal information with Suppliers and other Suppliers to process or complete transactions that you have requested. By accepting this Agreement, you confirm that you have read and understood our Privacy Policy.
n. There will not be any refund for any unused portion of a Booking. If you cancel while the trip is in progress, there is no refund for the unused portion. No refunds will be made for any travel arrangements not utilized, whether by choice or because of late arrival or early departure. This includes the failure of transportation Suppliers to operate according to schedule, which we disclaim responsibility for.
o. Force majeure. We assume no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (including, without limitation, COVID-19), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the Supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by us that impacts negatively on, or hampers, our or any Suppliers’ ability to fulfill any of our contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you – your Supplier is solely responsible for any refund. If we can recover any monies from our Suppliers, we will refund these to you in the form of WP Credits without any charge by us.
p. World Playground is committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns. But if we are unsuccessful, you or we may pursue claims as explained in this section. To give us an opportunity to resolve informally any disputes between you and us arising out of or relating in any way to the Website, these Terms and Conditions, our Privacy Policy, any services or products provided, any dealings with our customer service agents, or any representations made by us (“Claims”), you agree to communicate your Claim to World Playground by contacting World Playground customer support. You agree not to bring any suit or to initiate arbitration proceedings until 60 days after the date on which you communicated your Claim to customer support have elapsed. If we are not able to resolve your Claims within 60 days, you may seek relief as set forth below.
q. These Booking Conditions are governed by the laws of the State of Wyoming and we both agree that the courts of the State of Wyoming have exclusive jurisdiction over any dispute, claim or other matter which may arise between us. You agree that you will only bring claims against us in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. We shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages.
r. To the fullest extent provided by law, you further understand and agree that no claims will be considered and that you will not bring suit against World Playground unless you have first provided a written notice of claim to World Playground within thirty (30) days after the trip or cancellation of the trip, further provided that you agree to file suit within one (1) year of the incident and you acknowledge that this expressly limits the applicable statute of limitations to one (1) year. Any claims not submitted and received within this time shall be deemed irrevocably waived and barred.
